.UA Domain Name Dispute Resolution (Ukraine)

The Arbitration and Mediation Center of the World Intellectual Property Organization (WIPO) has announced that the .UA (Ukraine) procedures can resume from July 1, 2023, subject to some adjustments affecting the deadlines. According to the WIPO, the Ukrainian registry responsible for the administration of .UA domain names adopted this decision under martial law (wipo.int, 2023-06-30).

The last uaDRP decision (DUA2021-0028) was issued on January 10, 2022.

As a reminder, the uaDRP procedure differs slightly from the uniform UDRP procedure, namely:

  • the complainant can prove the bad faith of the respondent either at the registration stage or at the use stage;
  • the competent court must be a Ukrainian court; and
  • the language of the proceedings can only be Ukrainian, English or Russian.
