euADR: YMCA snatches ymca.eu from the hands of a well-known cybersquatter

Sixteen years after the creation of the European extension (in 2005) and thirteen years after the registration of the domain name ymca.eu (in 2008), the association (Young Men’s Christian Association) obtained the transfer of the latter to the outcome of an ADR procedure (CAC, ADR 07897, European Alliance of YMCAs (YMCA Europe), Marius Gabriel Pop v. Evolution Media eU, Domanin Manager, 2021-11-19, transfer; panelist: Dinant TL Oosterbaan).

The respondent’s bad faith was obvious mainly because of the reputation of the trademark and the attempt to sell the domain name (an offer for 999 euros). The panelist also pointed out that the respondent, on several occasions, had been involved in cybersquatting cases (citing in particular the following decisions: CAC, ADR 07600, Simba Sleep Limited, Turner, LLM v. Evolution Media eU, Domain Manager, 2018-02-26, <smba.eu>, transfer; CAC, ADR 07646, RULYT sro, RULYT srov Evolution Media eU, 2018-07-04, <lifeit.eu>, transfer; CAC, ADR 07720, ArcelorMittal ( SA), ArcelorMittal (SA) v. Evolution Media eU, 2019-03-19, <mittal.eu>, transfer).
