France: 2021-2022 anti-counterfeit programme

The French government published its plan to fight counterfeiting for the years 2021 and 2022. It sets the goals and puts forward the measures intended to achieve them. Fighting the proliferation of online counterfeiting is one of them.

France intends to strengthen the obligations imposed on payment service providers and online sales platforms.

To this end, the government supports, in particular, the implementation of preventive and proactive measures by marketplaces and social networks. It also recalls the recent announcements of the European Commission concerning the Digital Services ACT (DSA) in that it aims to i) define a new category that meets the criterion of the host conveying content to the public and ii) impose new obligations: transparency (reinforced for some platforms); and traceability of sellers.
