Reverse domain name hijacking: Surprising complaint and unexpected ruling

The domain name babyboom.com was recently the subject of a surprising UDRP complaint.

One may have a hard time believing that action by means of a UDRP complaint may be taken against such a generic domain name. Nevertheless, N2COM, a company specializing in video advertising decided to act against the domain name on the basis of their BABYBOOM trademark which designates... baby and parenting goods!

In 2007, N2COM had sent a cease-and-desist notice to the owner which was rebutted by the registrant's Counsel. Five years later, N2COM tried to purchase the domain name and their highest offer was made in 2015, for around 5,000$.

In 2017, the Complaint appears to be a plan C for N2COM.

The WIPO Panellists considered that in 2012, N2COM made an offer to purchase the domain name without alleging trademark infringement. The complaint having been filed a few months after the negotiations were unsuccessfully concluded, the Panel deemed that the Complaint was brought in bad faith and constituted an abuse of the administrative process.
